Supreme Court Rejects PIL on UGC-NET Re EXAM Cancellation, Directs Affected Students to File

The Supreme Court, on July 29, 2024, declined to entertain a Public Interest Litigation (PIL) challenging the cancellation of the University Grants Commission National Eligibility Test (UGC-NET) exam due to alleged question paper leaks. The bench, comprising Chief Justice D Y Chandrachud, Justice JB Pardiwala, and Justice Manoj Misra, emphasized that the PIL was not filed by the affected students but by a lawyer, Ujjawal Gaur. The court suggested that the actual aggrieved students should bring their concerns directly to the court.


The Union Education Ministry, on June 19, had decided to cancel the UGC-NET exam after receiving inputs indicating that the integrity of the exam might have been compromised. The ministry handed over the investigation to the Central Bureau of Investigation (CBI) to probe the alleged paper leak.

Advocate Ujjawal Gaur, through his petition, argued that the cancellation was arbitrary and unjust, causing distress and anxiety among the aspirants who had prepared rigorously for the exam. He also sought a stay on the proposed re-examination until the CBI completed its investigation. The plea asserted that the evidence suggesting the paper leak was doctored, undermining the grounds for the cancellation.

However, the Supreme Court, while declining the PIL, clarified that the dismissal was not a decision on the merits of the case, as it was not brought by the directly affected students. The court advised the lawyer to focus on other legal matters and leave such issues for those who are directly impacted to raise.
